Beleidsregels zijn gebaseerd op een bestuursbevoegdheid (0,5 punt); algemeen verbindende voorschriften (avv’s) zijn gebaseerd op een regelgevende bevoegdheid (0,5 punt).

Van beleidsregels kan – en moet soms zelfs – het bestuur afwijken: de zogenaamde inherente afwijkingsbevoegdheid, zie artikel 4:84 Awb. (0,5 punt); van avv mag alleen worden afgeweken als de avv daar zelf een ontsnappingsclausule voor bieden (0,5 punt).
