Welke onderwerpen worden behandeld in het hoorcollege?
Staatsrecht: De ideologische definitie is ‘Constitutional law is all abouw who We are as a People, where We have been, and where We might choose to go. It is al about how we respect and protect human dignity.’
Waar gaat het staatsrecht over? Het gaat over de staat en constitutie. De beginselen van de democratische rechtstaat zijn: legaliteit, machtenscheiding, rechtsbescherming bij onafhankelijke rechter, grondrechten en democratie.
Grootste uitdagingen van de samenleving in 2020:
1. Klimaatverandering en vervuiling
Link met staatsrecht: Voor kerst HR gaf bevel aan de staat om CO2 uitstoot te verminderen. Dit werd gebaseerd op de mensenrechten recht op leven art. 2 EVRM en persoonlijke levenssfeer art. 8 EVRM. Hieruit blijkt dat het recht wordt gebruikt om politieke beslissingen te nemen.
- Internationale veiligheid (oorlog, terrorisme)
- Inkomensongelijkheid
- Armoede en honger
- Mensenrechten en privacy
- Corruptie, accountability en inspraak
Oplossingen: De oplossing hiervoor is legitimatie. Overheidsmacht is legitiem als zij door burgers wordt geaccepteerd. Iets is aanvaardbaar bijvoorbeeld doordat het altijd al zo was (traditie), de persoon charisma heeft of doordat het werkt. De overheid is het best om onze vrijheid te beschermen. De constitutie legitimeert, maar er is daardoor ook meer behoefte aan legitimatie. Dit uit zich in de democratie, grondrechten, integriteit, onafhankelijke rechtspraak, rechtszekerheid en machtenspreiding.
Democratie in Nederland: Er zijn in grote lijnen 3 ontwikkelingen geweest. De eerste ontwikkeling is de versterking van het parlement. Dit wordt gevolgd door de materiële invulling van legaliteit en de verbreiding van de democratie.
