Casus
X is als voetganger door automobilist Y aangereden toen hij buiten de bebouwde kom over een tweebaansweg liep. De maximumsnelheid op de weg bedroeg tachtig kilometer per uur. Ten tijde van het ongeval was het donker en regenachtig. Op de weg was geen straatverlichting aanwezig. X liep met zijn rug naar de achteropkomende auto van Y en heeft niet achterom gekeken. X droeg donkere kleding en had ongeveer zes blikjes bier gedronken. X heeft de WAM-verzekeraar van Y aansprakelijk gesteld. De verzekeraar heeft aansprakelijkheid betwist met een beroep op overmacht en aan opzet grenzende roekeloosheid.
Rechtbank
De rechtbank heeft bovenstaande verweren verworpen en de verzekeraar veroordeeld – op grond van de 50% regel – tot vergoeding van 50% van de schade.
Hof
Het Hof heeft het vonnis van de rechtbank vernietigd. Het Hof heeft het beroep op overmacht verworpen, maar wel geoordeeld dat sprake is van aan opzet grenzende roekeloosheid. Het Hof heeft hiertoe overwogen dat het als aan opzet grenzende roekeloosheid moet worden beschouwd dat X in de gegeven omstandigheden in het donkeer, zonder achterom te kijken op een onverlichte weg liep waar 80 kilometer per uur is toegestaan. X wist of had moeten weten dat automobilisten hem niet meer zouden kunnen ontwijken op het moment dat zij hem redelijkerwijs konden waarnemen. Hier doet het alcoholgebruik van X niks aan af.
Hoge Raad
De Hoge Raad kan zich vinden in het oordeel van het Hof. Deze overweegt dat voor aan opzet grenzende roekeloosheid als bedoeld in de 50% regel in beginsel bewustheid van het gevaar bij het slachtoffer is vereist. De bewijslast rust bij de aansprakelijk gestelde partij. Voor het bewijs van de bewustheid kan echter worden volstaan met het bewijs van feiten en omstandigheden waaruit die bewustheid kan worden afgeleid. Hoge Raad bekrachtigt het arrest van het Hof.
