Casus
Eiser tot cassatie is aansprakelijk gesteld voor de materiële schade die veroorzaakt is doordat hij met zijn auto frontaal is aangereden tegen de bebakeningseenheid die ten doel had het verkeer van de rechter – naar de linkerijstrook te dirigeren. Hij beriep zich op overmacht als bedoeld in art. 31 lid 1 WVW, subsidiair op schuld van de wegbeheerder als bedoeld in art. 31 lid 6 WVW en voerde aan dat de verlichting van de bebakeningseenheid niet naar behoren functioneerde waardoor de bebakeningseenheid slecht zichtbaar was en dat de situatie ter plaatse onoverzichtelijk was, mede door de verlichting van het hiervoor vermelde tankstation. Rechtbank en hof hebben dit verweer verworpen.
Hoge Raad
Wegbeheerders moeten verkeerstekens en bebakening zo plaatsen dat ook verkeer dat harder rijdt dan is toegestaan en minder oplettend is dan vereist, voldoende wordt gewaarschuwd en vervolgens gelegenheid heeft zich aan de omstandigheden aan te passen. De overige klachten miskennen de grenzen van hetgeen in cassatie nog aan de orde kan komen, allemaal van feitelijke aard. De aangevallen oordelen zijn evenwel niet onbegrijpelijk of onvoldoende gemotiveerd. De Hoge Raad verwerpt het verzoek.
