De Europese Commissie heeft onder verwijzing naar de staatssteunregels van de EU onderzoek gedaan naar mogelijk illegale staatssteun door Luxemburg aan McDonald's. Verschillende winsten van McDonald's werden namelijk niet door Luxemburg belast. Volgens EU-regels is het niet de bedoeling dat lidstaten bepaalde bedrijven bevoordelen ten opzichte van andere bedrijven. De vraag is of daar in dit geval sprake van was.
Casus
In maart 2009 gaf Luxemburg aan McDonald's een 'tax ruling' af, waarin bepaald werd dat het bedrijf geen belasting in Luxemburg hoefde te betalen, omdat de winsten in de Verenigde Staten belast werden. Deze afspraak kwam voort uit een belastingverdrag tussen Luxemburg en de Verenigde Staten, dat erop gericht is dubbele belasting te voorkomen. Later werd afgesproken dat McDonald's niet aan de Luxemburgse overheid hoefde te bewijzen dat de in Luxemburg vrijgestelde winsten in de Verenigde Staten wél belast werden.
De Commissie heeft onderzocht of deze constructie er niet voor zorgde dat McDonald's oneerlijk bevoordeeld werd. De conclusie van het onderzoek is dat dit niet het geval was. Alhoewel de winsten van McDonald's als een gevolg van de tax ruling niet in Luxemburg, én niet in de Verenigde Staten belast werden, is dit niet het gevolg van een oneerlijke behandeling. Het is het gevolg van de afspraken tussen de Verenigde Staten en Luxemburg over belastingheffing.
Politieke context
De Luxemburgse regering zoekt naar mogelijkheden om deze afwezigheid van belastingheffing op de winst van grote bedrijven in de toekomst te voorkomen. De Europese Commissie wil dit soort tax rulings, hoewel niet illegaal, zoveel mogelijk tegengaan. De Commissie is namelijk van mening dat deze afspraken een eerlijke concurrentie tussen bedrijven in de weg staan. Daarom doet de Commissie ook onderzoek naar andere tax rulings van lidstaten, bijvoorbeeld van Nederland en Ierland.
