Wat zijn de veranderingen in de hoorcolleges?

Wat is belangrijk voor het tentamen?
- Belangrijk voor het tentamen is om van strafrecht 1 de voorwaarden voor strafbaarheid/structuur van het stafbare feit en het strafprocessueel beslissingsmodel van art. 350 Sv te begrijpen. Dit blijft ook in strafrecht 2 terugkomen
- Indien het in een casus op het tentamen gaat om opzet. Gelden er drie kernvragen namelijk:
1. Waarop moet opzet gericht zijn?
Hoofdregel: opzet heeft betrekking op de bestanddelen die na het opzet worden genoemd. Let op de geobjectiveerde bestanddelen! Een voorbeeld hiervn is art. 300 lid 1 jo. lid 2/3
2. Betekenis van opzet?
Opzet is willen én weten. Had kunnen weten, had moeten weten en had behoren te beweten.
3. Hoe is opzet te bewijs?
Bewijs van "weten": bewustheid van aanmerkelijke kans. Dit kan worden bewezen middels ervaringsregels en feiten van algemene bekendheid.
- Belangrijk voor het tentamen is de rechtsregels te kennen van: Slaan met pistool-arrest, Onvoldoende rechts houden te Winssen-arrest, Geervliet-arrest en Roekeloosheid in het verkeer-arrest.
