Aids-test (HR 18-06-1993, NJ 1994, 347)
Casus
Man verkracht vrouw. Verkrachting vond plaats zonder condoom. Man heeft daarvóór veel sexuele contacten gehad. Vrouw eist bij man bloedonderzoek, met het oog op aanwezigheid HIV-virus (leidend tot fatale AIDS). Dat onderzoek kan (medisch gespro-ken) ook bij vrouw plaatsvinden, maar is voor haar een zware emotionele belasting. Man weigert, President beveelt man tot bloedonderzoek.
Rechtsvraag
Is bevel aan verkrachter tot bloedonderzoek (HIV-virus) in strijd met art. 11 Grondwet?
Hoge Raad
Art. 11 Grondwet luidt: "Ieder heeft, behoudens bij of krachtens de wet te stellen beperkingen, recht op onaantastbaarheid van zijn lichaam." Het grondrecht ex art. 11 vindt dus zijn grenzen in de bij of krachtens de wet te stellen beperkingen. In elk geval tussen burgers onderling kan een zodanige beperking in beginsel worden gegrond op art. 1401 (tegenwoordig: art. 6:162 BW).
Of art. 162 daarvoor in een concreet geval voldoende grondslag biedt, is afhankelijk van de omstandigheden van het geval. Gelet op: *de ernst van en opzet bij het gepleegde delict: verkrachting, *de gevolgen ervan: onzekerheid bij het slachtoffer omtrent besmetting met HIV-virus, welke onzekerheid diep ingrijpt in haar persoonlijk leven,
*voor de hand liggende ernstige emotionele bezwaren tegen een nieuw bloedonderzoek: de vrouw had -te vroeg- een eigen bloedonderzoek ondergaan, moet zo`n beperking op art. 11 Grondwet in dit geval worden aanvaard. Die beperking is ook moet voldoende scherpte uit de normen af te leiden.
Commentaar
Dit arrest gaat onder andere over horizontale werking van grondrechten, want over de werking van grondrechten tussen burgers onderling (en niet tussen burger en overheid). Het grondrecht van art. 11 kan ook de dader inroepen tegenover het slachtoffer.
Dit arrest gaat ook over beperking van grondrechten. Het grondrecht van de dader wordt hier niet beperkt door een grondrecht van het slachtoffer (dan zou sprake zijn van bot-sing van grondrechten), maar door "gewone" rechten van het slachtoffer. De vrouw had zich hier -om een tweede eigen bloedonderzoek te voorkomen- ook op art. 11 Gw kunnen beroepen.
