Delftse gondelaffaire (HR 11-11-2011, ECLI:NL:HR:2011:BU3917)

Casus

De Delftse raadslid Martin Stoelinga werd door een wethouder van Delft beschuldigd van corruptie, naar aanleiding van een in een Delftse pizzeria in het geheim opgenomen beeld- en geluidopnames uit 2004 en 2005, waarin de wethouder verschillende telefoongesprekken afhandelt. De wethouder stelde dat hij zich niet onethisch had gedragen en dat de uitingen van Stoelinga onrechtmatig waren. Hiertoe startte hij een procedure tegen Stoelinga en zijn partij.

Hoge Raad

De Hoge Raad heeft bepaald dat Stoelinga niet onrechtmatig heeft gehandeld. De Hoge Raad merkte op dat het ging om uitingen van een oppositie-lid, waarbij het voor het goed functioneren van de democratie noodzakelijk is dat er de grootst mogelijke terughoudendheid moet worden betracht bij de toetsing of deze uitingen onrechtmatig zijn. Daarbij verwijst de Hoge Raad naar artikel 10 EVRM, waarin de vrijheid van meningsuiting is vastgelegd. Deze vrijheid heeft niet enkel betrekking op de inhoud, maar ook op de vorm. Deze vrijheid geldt ook voor uitlatingen van een politicus die buiten de gemeenteraad zijn gedaan.
