De term roekeloosheid in de Wegenverkeerswet 1994 geeft veel verwarring. Ook is de maatschappij van oordeel dat ‘doodrijders’ te laag worden gestraft. Er werd een wetsvoorstel gedaan. Na onderzoek blijkt dat de strafoplegging bij verkeersdelicten ‘adequaat’ is. Naarmate de ernst van het letsel toeneemt worden de straffen hoger. Is er sprake van strafverzwarende omstandigheden die specifiek genoemd worden in de wet, dan kan de straf met de helft worden verhoogd. Toch blijft de maatschappelijke onrust. Voor slachtoffers is de straf nooit hoog genoeg. Daar hoeft echter niet altijd gehoor aan te worden gegeven. De discussie spitst zich toe op de term roekeloosheid. Voor roekeloosheid is meer nodig dan bumperkleven. De Hoge Raad post dan ook op haar website dat ‘onder invloed van alcohol of door veel te hard rijden een ongeluk veroorzaken onvoldoende is om te worden veroordeeld voor roekeloos een ongeluk veroorzaken. Als de wetgever dit anders wil moet hij de wet aanpassen. Ook als roekeloosheid in juridische zin niet bewezen kan worden, kan binnen het huidige strafrecht dood door schuld in combinatie met alcoholgebruik of veel te hard rijden worden bestraft tot 4,5 jaar gevangenisstraf. Ook hier geldt, als de wetgever dat niet genoeg vindt, kan hij de strafmaxima verhogen.
