The Case of the S.S. 'Lotus' (Permanent Court of International Justice, 07-09-1927)

Casus

De S.S. Lotus, een Frans stoomschip, botst met een Turks stoomschip in de buurt van Griekenland. Acht van de opvarenden van het Turkse stoomschip overlijden hierop. Vervolgens wil de Turkse overheid de Franse wacht, die destijds verantwoordelijk was voor de wacht, aansprakelijk stellen. Vraag hierop is of de Turken jurisdictie hebben.

Staten mogen zich volgens de court op iedere manier gedragen die niet indruist tegen een direct verbod. Frankrijk beweerde dat de vlag onder welke het schip voer, dan ook de jurisdictie heeft. Zij beweert dat 'case law', customary international law, dit ondersteunt. The Court wijst deze opstelling af.

De redenatie van Turkije houdt in dat, aangezien het zijn burgers zijn die omgekomen zijn, zij dan ook jurisdictie hebben. The Court stelt Turkije in het gelijk, aangezien er twee schepen zijn en beiden dus jurisdictie hebben. Het is dan ook niet zo dat Frankrijk exclusieve jurisdictie toekomt.
