Casus
Gedaagde heeft aan eiseressen mededeling gedaan omtrent een eigen bijdrage terzake van reeds verleende kraamzorg. Er wordt beroep gedaan op het ILO-verdragen 102 en 103, welke een eigen bijdrage uitsluiten.
Rechtsvraag
De rechtsvraag is ‘of de in dit geding relevante onderdelen van voornoemde bepalingen van ILO-verdrag 102, te weten art. 10 lid 1 aanhef en onder b, alsmede art. 49 lid 2 moeten worden beschouwd als een ieder verbindende verdragsbepalingen in de zin van de art. 93 en 94 Grondwet’. (p. 187 reader 2005-06)
Rechtsregel
‘De omschrijving van de te verlenen verstrekkingen, alsmede de imperatieve redactie van de bepalingen in relatie tot het minimum-karakter zowel van het verdrag in zijn algemeenheid als van deze bepalingen in het bijzonder, bewerkstelligen dat deze zich ertoe lenen door de beschermde personen te worden ingeroepen ter toetsing van de krachtens het nationale recht verleen aanspraken aan de standaard van het verdrag, zodat in die zin kan worden gesproken van verdragsbepalingen die naar haar inhoud een ieder kunnen verbinden in de zin van art. 93’.
