De vraag die in deze tekst centraal luidt: zal een speech die aanzet tot haat getolereerd worden in een goed geordende samenleving? Er kan een onderscheid gemaakt worden tussen twee mogelijke antwoorden.
Het eerste antwoord laat een speech die aanzet tot haat toe op grond van energieke diversiteit van de vrije markt van ideeën. Het andere antwoord stelt dat een samenleving niet goed geordend kan zijn als mensen pleiten voor racistische of religieuze vijandschap. Het idee van een goed geordende samenleving is het idee van een samenleving die volledig en effectief bestuurd wordt door een conceptie van rechtvaardigheid.
Volgens Waldron kan een samenleving niet goed geordend worden genoemd, totdat het zaaien van haat is uitgestorven en vervangen is door gevoelens van gerechtigheid. Een samenleving kan niet goed geordend worden zolang onder andere de racisten hun missie niet opgeven en de basis principes aanvaarden over rechtvaardigheid en gelijkwaardigheid.
Volgens Waldron moeten we hopen dat het zaaien van haat uitsterft, niet door wetten die beperkingen opleggen, maar door een verandering in het hart door middel van bijvoorbeeld publieke scholing. Een volgende vraag die gesteld kan worden luidt: waarom maakt het uit hoe een goed geordende samenleving eruit ziet? Het antwoord heeft te maken met veiligheid en zekerheid.
Waldron is van mening dat het uitgangspunt in een goed geordende samenleving moet zijn dat niet alleen mensen worden beschermd door de wet, maar ook het vertrouwen in deze bescherming. Elk persoon zou moeten kunnen leven zonder geconfronteerd te worden door vijandigheid, geweld, discriminatie of uitsluiting. De speech die aanzet tot haat ondermijnt dit essentiële publieke goed.
De bescherming van de veiligheid zal verdwijnen als een samenleving geconfronteerd wordt met anti-semitische uitingen, brandende kruizen en racistische pamfletten. De waakzame politie en het Ministerie van justitie kunnen weliswaar voorkomen dat mensen worden aangevallen of uitgesloten, maar niet dat zij worden verstoken van de zekerheid dat de maatschappij hen beschouwt als mensen van gelijke waarde.
De speech die aanzet tot haat moet niet als onbelangrijk worden beschouwd. Enkele specifieke incidenten kunnen al het effect hebben dat het ’publieke goed’ het geding komt.
