Casus
Er vindt een zware ruzie plaats tussen leden van verschillende families. Op straat raken zij slaags met elkaar. Kort gezegd gaat het om leden van familie A en leden van familie B. Laatsgenoemden moeten het ontgelden; zij krijgen fikse klappen te verduren. Uiteindelijk ziet één van de broers van familie B, de mogelijkheid om een koevoet uit de gang te pakken en de inbeukactie op zijn broer te beëindigen. Hij zal zich later beroepen op noodweerexces.
Rechtsvraag
Is voldaan aan de voorwaarden voor een succesvol beroep op noodweerexces?
Hoge Raad
Een beroep op noodweerexces is succesvol indien aannemelijk is dat aan de volgende stappen is voldaan:
1. wederrechtelijke aanranding
2. hevige gemoedsbeweging door 1
3. gedraging onmiddelijk gevolg van 2
Het Hof heeft volgens de HR een te beperkte maatstaf gehanteerd. Voor een succesvol beroep op noodweerexces, moeten de nummers 1 t/m 3 zo worden gezien, dat 3 weliswaar direct verband moet houden met 2, maar het verband tussen 2 en 1 mag niet zo beperkt worden uitgelegd dat het aan de orde zijn van andere factoren die leiden tot een hevige gemoedsbeweging, per definitie resulteert in een afwijzing van een beroep op noodweerexces.
Tevens is niet begrijpelijk volgens de HR, waarom een koevoet per definitie niet voldoet aan de eisen van proportionaliteit en subsidiariteit, en derhalve in de weg zou staan aan een beroep op noodweerexces.
