Noodweerexces en illegaal vuurwapen - Arrest
Casus
Nadat het latere slachtoffer - van wie verdachte wist dat hij erg jaloers was en als gevaarlijk bekend stond - enkele weken voordat het bewezenverklaarde feit plaatsvond verdachte had bedreigd met de dood indien verdachte zich met de relatie met diens vriendin zou bemoeien, is de verdachte - overigens zonder daartoe een vergunning te hebben - een geladen pistool bij zich gaan dragen om zich te kunnen verdedigen voor het geval dat het latere slachtoffer hem zou aanvallen. Hij had dit wapen voortdurend bij zich. Op 11 maart 2001 heeft verdachte de vriendin van het latere slachtoffer ontmoet in een café. Verdachte heeft haar omstreeks 3.00 uur thuisgebracht. Hij heeft zijn auto op enige afstand van haar woning geparkeerd. Hij is de woning van het latere slachtoffer en diens vriendin ingegaan, nadat de vriendin hem had verzekerd dat het latere slachtoffer, met wie zij relatieproblemen had, twee weken bij zijn broer logeerde en haar had toegezegd haar gedurende deze periode met rust te laten. Verdachte die nog over een sleutel van de woning beschikte, heeft de deur van de woning van binnen op het nachtslot gedaan. Hij is met de vriendin van het latere slachtoffer naar de slaapkamer op de eerste verdieping gelopen. Kort daarop heeft het latere slachtoffer aangebeld, heeft hij onmiddellijk daarna de deur van de woning ingetrapt en is hij met grote snelheid de trap op gelopen. Toen hij dit rumoer hoorde, besefte verdachte dat het latere slachtoffer de woning was binnengedrongen en heeft hij zijn pistool uit zijn jas, die op de zonnebank in de slaapkamer lag, gepakt en dit doorgeladen. Inmiddels was het latere slachtoffer boven aangekomen, had hij zijn vriendin met geweld opzij geduwd en kwam hij met een dolk in zijn opgeheven hand de slaapkamer waar verdachte zich bevond, binnen. De verdachte heeft toen tweemaal kort achter elkaar in de richting van het latere slachtoffer geschoten.
Rechtsvraag:
Noodweer (exces) of culpa/dolus in causa?
De instanties:
De Hoge Raad volgt het oordeel van het Hof. Het Hof beslist dat de verdachte niet uit is geweest op een confrontatie met het latere slachtoffer. Dit wordt afgeleid uit de feiten dat hij zijn auto op een afstand van het huis parkeert, dat hij zich er van heeft gewist dat het latere slachtoffer de vriendin met rust zou laten en de woning op het nachtslot heeft gedraaid.
Het hof acht het enkele feit dat verdachte met de vriendin van het latere slachtoffer de woning is binnengegaan en daarbij zijn (geladen) pistool heeft meegenomen niet zodanig onvoorzichtig, laat staan rechtens laakbaar, dat hem op die grond een beroep op noodweer moet worden ontzegd.
