De Groot/Io Vivat, HR 23-02-2007, NJ 2008, 492 (Zeilongeval) - Arrest
Feiten
Studentenvereniging Io Vivat uit Leeuwarden organiseerde een zeilweekend. Tijdens dat weekend is in de kajuit van de motorboot een gasfles gelekt. Hierdoor is een ontploffing en steekvlam ontstaan. De Groot, een commissielid van de commissie voor het zeilweekend, loopt op dat moment net de kajuit in en loopt ernstige brandwonden op. De Groot stelt de vereniging Io Vivat aansprakelijk wegens het gebrek aan toezicht. Blijkbaar waren er een aantal fouten door de commissie gemaakt, waardoor dit ongeluk had plaatsgevonden. De Groot zat zelf in commissie Watersport. Hij was medeorganisator van het weekend en had zelf in het toezicht gefaald.
Zowel de rechtbank als het hof wezen de vordering af. Volgens het hof mocht aan zo een zeilweekend niet te hoge eisen aan het toezicht gesteld worden, omdat op alle deelnemers een grote eigen verantwoordelijkheid rust. Voor zover er toezicht gehouden moest worden, ligt dit bij de commissie en De Groot was zelf een van de leden. De Groot kan de vereniging daarom niet een gebrek aan toezicht verwijten, omdat hij zelf deelnemer van het weekend en lid van de commissie was. De Groot kan de vereniging dus niet verwijten, wat hij zelf ook heeft nagelaten, daarom is de vereniging niet aansprakelijk.
Hoge Raad
Is de vereniging Io Vivat aansprakelijk voor de schade die De Groot heeft opgelopen?
De Hoge Raad gaat mee met het hof en oordeelt dat het hof juist heeft geoordeeld door te stellen dat, de geschonden norm niet strekt tot de bescherming van De Groot nu hij zich zelf ook niet naar deze norm heeft gedragen. M.a.w. degene die de norm waarvan hij de bescherming inroept zelf schendt, kan aan die norm geen bescherming ontlenen, omdat hij zich ook zelf niet naar die norm heeft gedragen.
Conclusie; Wanneer iemand zich zelf ook niet naar een bepaalde norm heeft gedragen, dan kan hij ook niet een ander voor het schenden van deze norm aanspreken.
Als commissaris watersport was De Groot zelf verantwoordelijk voor het toezicht op de veiligheid en kon hij het ontbreken van dat toezicht niet aan zijn studentenvereniging tegenwerpen.
