Casus
Bij besluit van 22 december 2006 heeft het college van B&W van Steenwijkerland aan Recracenter BV een kampeerexploitatievergunning onder voorschriften verleend op basis van de (toenmalige) Wet op de openluchtrecreatie (Wor). Hiertegen is door verschillende BV’s van Recracenter (hierna: Recracenter) bezwaar gemaakt, waarna het college bij besluit op bezwaar van 27 juli 2007 het verleningsbesluit heeft herroepen en de vergunning alsnog heeft geweigerd. Volgens het college was er geen rechtsgrond voor het verlenen van de vergunning, omdat de te plaatsen recreatieobjecten geen caravans waren in de zin van art. 1 lid 3 Wor.
De rechtbank heeft het beroep van Recracenter ongegrond verklaard, waarna Recracenter hoger beroep instelt bij de Afdeling Bestuursrechtspraak.
Rechtsvragen
Heeft het college bij het nemen van het besluit op bezwaar in strijd met art. 7:11 lid 1 Awb gehandeld door ten onrechte buiten de grenzen van het geschil te treden?
Heeft het college met het herroepen van het voor Recracenter begunstigende besluit van 22 december 2006 gehandeld in strijd met het verbod van ‘reformation in peius’?
Rechtsregel
De bezwaarschriftprocedure is bedoeld voor een volledige heroverweging. Het college had zich dus niet hoeven beperken tot de argumenten en omstandigheden die Recracenter in het bezwaarschrift naar voren had gebracht. Het college was dan ook bevoegd om de criteria van het begrip caravan ex art. 1 lid 3 Wor in zijn oordeel te betrekken.
Een bestuurlijke heroverweging kan tot gevolg hebben dat het besluit op bezwaar een achteruitgang betekent voor een belanghebbende. Het college is – net als het bestuur als geheel – gebonden aan de wet en is daarom niet gehouden tot het handhaven van een verleende vergunning wanneer de heroverweging tot een ander oordeel had geleid
