Casus
In deze zaak was er sprake van een erfpachtovereenkomst tussen de gemeente Amsterdam en Ikon Beleidskonsulenten BV. In de overeenkomst was opgenomen dat Ikon het perceel in kwestie moest inrichten en gebruiken als woonhuis, tenzij de gemeente akkoord zou gaan met verandering van de bestemming.
Ikon schende de bepaling door het perceel niet als woonhuis maar als kantoorruimte te gebruiken. De gemeente richtte zich tot de burgerlijke rechter om Ikon te verbieden het perceel anders dan als woonhuis te gebruiken. Volgens Ikon was hier sprake van schending van het gelijkheidsbeginsel omdat de gemeente ten opzichte van veel andere vergelijkbare gevallen niet optrad. Hiertegen voerde de gemeente aan dat de algemene beginselen van behoorlijk bestuur bij de uitoefening van privaatrechtelijk bevoegdheden niet in acht hoeven te worden genomen.
Ook stelde de gemeente dat als de algemene beginselen van behoorlijk bestuur en het gelijkheidsbeginsel in zulke rechtsverhouding wel van betekenis zou zijn, de betekenis ervan zwakker zou zijn.
Hoge Raad
De Hoge Raad dient zich te buigen over deze zaak een oordeelt dat de algemene beginselen van behoorlijk bestuur ook voluit als toetsingscriterium gelden voor privaatrechtelijke rechtshandelingen van de overheid.
De Hoge Raad oordeelt: “Een overheidslichaam behoort bij het uitoefenen van zijn bevoegdheden uit een erfpachtsverhouding de algemene beginselen van behoorlijk bestuur – en derhalve ook het gelijkheidsbeginsel als één van die beginselen – in acht te nemen.(…) Dat het gelijkheidsbeginsel hier slechts aan de orde zou kunnen komen in het kader van de toepassing van een aan de overheid meer ruimte latende redelijkheidsmaatstaf en daarom hier een zwakkere werking dan in het bestuursrecht zou hebben, gaat uit van een onjuiste rechtsopvatting".
Algemene beginselen van behoorlijk bestuur worden dus van toepassing verklaard op het privaatrechtelijk handelen van de overheid.
