Gedoogde Hoogeloonse Stal ABRvS 24-4-2019, ECLI:NL:RVS:2019:1356
Feiten
I.c. gaat het om een geschil tussen een perceel eigenaar en het college van B&W van Bladel. Op het betrokken perceel staat een stal met overkapping (gebouwd in 1933). Er kan echter niet worden vastgesteld of hier ooit een bouwvergunning voor is verleend. Gelet hierop heeft het college een gedoogbeslissing genomen. In de gedoogbeslissing staat dat de eigenaar het bouwwerk mag laten staan onder een aantal voorwaarden. Hiertegen heeft hij beroep ingesteld.
De Afdeling moet dan beslissen of een gedoogbeslissing een (appellabel) besluit is.
ABRvS
Is een gedoogbeslissing een appellabel besluit? Volgens de Afdeling is de aan de perceel eigenaar verleende gedoogbeslissing geen appellabel besluit. De gedoogbeslissing kan ook niet gelijkgesteld worden met een besluit. Voor zover de gedoogbeslissing moet worden aangemerkt als een bestuurlijk rechtsoordeel, betekent dat niet dat de brief moet worden gelijkgesteld met een besluit in de zin van art. 1:3 Awb.
De eigenaar kan een handhavingsbesluit afwachten of een (legaliserende) aanvraag om omgevingsvergunning indienen bij het college. Dit is volgens de Afdeling niet onevenredig bezwarend. Als de eigenaar een aanvraag om een omgevingsvergunning indient, dan kan het college bij het beslissen op de aanvraag om omgevingsvergunning eerst de voorvraag beantwoorden of er sprake is van een vergunningplicht. Het college kan onderzoeken of voor het bouwwerk al eerder een omgevingsvergunning is verleend. De eigenaar kan, als dat gelet op de beslissing op zijn aanvraag nodig is, het oordeel over de vergunningplicht in bezwaar en beroep ter discussie stellen.
Kortom, het college had het bezwaar van de eigenaar tegen de gedoogbeslissing niet-ontvankelijk moeten verklaren, omdat de gedoogbeslissing geen besluit is als bedoeld in art. 1:3 van de Awb en ook kan het niet daarmee worden gelijkgesteld.
Kern
Een gedoogbeslissing is geen besluit. Beslissingen omtrent gedogen zijn geen besluiten en kunnen ook niet worden gelijkgesteld met een besluit. Daarom kan dit niet worden aangevochten bij de bestuursrechter. Alleen in zeer uitzonderlijke gevallen moet worden afgeweken van deze benadering. Kortom, een gedoogbeslissing heeft weinig waarde.
