Jachtschietcentrum - Arrest - ABRvS 22 aug. 2005 (ECLI:NL:RVS:2005:AU1743)
Feiten
I.c. gaat het om een geding tussen de "Vereniging Nationaal Jachtschietcentrum Berkenhorst" (verzoekster) en het college van burgemeester en wethouders van Nunspeet (verweerder). Bij besluit van 12 juli 2005 heeft verweerder aan de vereniging een last onder dwangsom opgelegd vanwege het zonder vergunning schieten op een bovengrondse schietbaan. Tegen dit besluit heeft verzoekster bezwaar gemaakt.
Voor de schietactiviteiten waren eerder gedoogverklaringen afgegeven. De vereniging daarom voert aan dat het College niet in redelijkheid heeft kunnen overgaan tot handhaving. Zij wijst er op dat voor de activiteit waartegen wordt opgetreden een gedoogverklaring is afgegeven. De vereniging heeft om schorsing van het besluit verzocht en heeft gesteld dat een (nieuwe) gedoogverklaring onder strengere geluidsbeperkingen mogelijk moet zijn. De vraag die dan centraal staat is of een gedoogverklaring een duurzaam beletsel vormt om handhavend op te treden.

De voorzitter stelt vast dat in 2001 en in 2005 gedoogverklaringen zijn afgegeven. De bij besluit van 31 maart 2005 afgegeven gedoogverklaring omtrent het schieten is geschorst. Met betrekking tot de gedoogverklaring van 2001 geldt dat zo’n verklaring naar haar aard niet leidt tot een duurzaam beletstel van handhavend optreden.
De Voorzitter overweegt dat de gedoogverklaring reeds jaren terug is afgegeven en verweerder, ook al voor het besluit van 12 juli 2005, te kennen heeft gegeven niet meer achter deze gedoogverklaring te staan, in welk kader hij ook een nieuw gedoogbesluit heeft genomen.
Gezien ook de omstandigheid dat in de gedoogverklaring van 2001 geen geluidsgrenswaarden zijn opgenomen vormt deze gedoogverklaring geen bijzondere omstandigheid die aanleiding zou moeten geven om van handhavend optreden af te zien.
Dat het wellicht mogelijk is een gedoogverklaring af te geven met strengere geluidgrenswaarden dan in de gedoogverklaring van 31 maart 2005 vormt ook geen bijzondere omstandigheid.
