Adviescommissie basisstipendia (ABRvS 11-01-2000)
Casus
Bij besluit van 2 mei 1997 heeft appellant geweigerd om aan A een basisstipendia voor beeldende kunstenaars toe te kennen. Een basisstipendium stelt kunstenaars in de gelegenheid hun beroepsuitoefening te continueren. Op basis van artikel 14 van de Regeling basisstipendia voor beeldende kunstenaars was appellant verplicht over de aanvraag advies te vragen aan een werkgroep. Op basis van artikel 16, lid 1, van deze Regeling wordt een basisstipendia alleen toegekend bij een positief besluit van deze werkgroep. Op 17 april 1997 bracht deze een negatief advies uit. Naar aanleiding van het door A gemaakte bezwaar bracht de werkgroep een nieuw advies uit. Het was nog steeds negatief, maar de motivering was gewijzigd. Appellant wees het bezwaar van A af.
Bij uitspraak van 9 april 1999 heeft de rechtbank het door A ingestelde beroep gegrond verklaard. Volgens de rechtbank is er bij het besluit omtrent het toekennen van het basisstipendium onvoldoende kennis vergaard omtrent de relevante feiten en de af te wegen belangen. Het besluit berust niet op een deugdelijke motivering wat in strijd is met artikel 3:2 en 7:12 van de Awb. Appellant stelt hoger beroep in bij de Raad van State.
ABRvS
In gevallen waarin een bestuursorgaan verplicht advies moet vragen, art. 3:5 Awb, is het bestuursorgaan verplicht na te gaan of het door de adviseur gedane onderzoek op zorgvuldige wijze tot stand is gekomen, zowel procedureel als inhoudelijk. Omdat het hier gaat om een subjectief oordeel, worden er slechts beperkte motiveringseisen aan een besluit gesteld en hoeft het bestuursorgaan slechts marginaal te toetsen. Het gaat erom dat de aanvrager inzicht krijgt in het de gedachtegang die aan het advies ten grondslag ligt. Het advies voldoet aan die eis.
De Afdeling vernietigt de uitspraak van de rechtbank en verklaart het ingestelde beroep gegrond.
