Methadonbrief (HR 27-06-1986, ECLI:NL:HR:1986:AM9331)
Casus
De inspecteur van het staatstoezicht op de volksgezondheid stuurt aan alle Nederlandse artsen een brief over hoe te handelen inzake ambulante behandeling van verslaafden aan opiumwetmiddelen. Deze brief staat bekend als de methadonbrief. In die brief wordt artsen geadviseerd slechts onder bepaalde omstandigheden aan drugsverslaafden een recept voor methadon (een drugsvervangend middel) mee te geven. De Groningse arts Rauwerda geeft ook in andere omstandigheden een recept mee aan verslaafden.
Daarop stuurt de inspectie een tweede brief aan de plaatselijke apothekers, met het "verzoek" geen methadon meer te verstrekken op een recept van dr. Rauwerda.
Rechtsvraag
Is de handelswijze van de inspectie onrechtmatig of handelt zij op grond van een wettelijke bevoegdheid?
Hoge Raad
Omdat de inspecteur geen bevoegdheid heeft tot het geven van bindende voorschriften over hoe artsen hun praktijk dienen uit te oefenen, is de Methadonbrief (aan de artsen) niet meer dan een advies. Het niet opvolgen van het advies door een arts zou in strijd kunnen zijn met de Medische Tuchtwet, maar dit mag alleen worden beoordeeld door bijzondere colleges (krachtens Medische Tuchtwet) of de rechter. De inspecteur heeft in geen geval de bevoegdheid om naleving van het advies af te dwingen.
De tweede brief (aan de apothekers) was wel degelijk een poging om Rauwerda tot naleving te dwingen, hoewel het slechts een “verzoek” bevatte. Doordat de brief afkomstig was van de inspecteur, aan wie de wet gezag toekent, volgden apothekers het verzoek.
