Komt Wolterink bescherming toe op basis van art. 3:86 lid 3 sub a BW? Kortom: was hij daardoor beschikkingsbevoegd en heeft hij daardoor eigendom over kunnen dragen aan Uitslag?
Casus
Uitslag heeft een caravan gekocht van Wolterink. Wolterink had deze caravan daarvóór gekocht van Koster. Koster is een caravanhandelaar die handelde vanaf een bedrijfsterrein met daarop een twintigtal te koop staande caravans en een in een caravan gevestigd kantoortje. Er is in 1994 bekend geworden dat de bedoelde caravan is gestolen van E. Buitenhuis. Diens schadeverzekeraar heeft de caravan bij Uitslag opgeëist en deze heeft aan de vordering voldaan. Uitslag wil de overeenkomst met Wolterink nu ontbinden op grond van het niet verschaffen van de eigendom door Wolterink.
Rechtbank
De rechtbank vindt het te ver voeren om Wolterink de bescherming niet te geven enkel omdat de caravan niet duurzaam met de grond verenigd is. De continuïteit is niet van belang voor de zaak.
De rechtbank wijst de vordering af.
Hof
Grieven:
- Ten onrechte overweegt de rechtbank dat de goede trouw van Wolterink niet ter discussie staat.
- Ten onrechte vindt de rechtbank het te ver voeren om de beslissing af te laten hangen van de vraag of de caravan duurzaam verbonden is met de grond
- Ten onrechte heeft de rechtbank de vordering van Uitslag afgewezen.
Het Hof wijst de grieven alle af.
Hoge Raad
De HR oordeelt dat voor Wolterink geen reden bestond om er niet op te mogen vertrouwen dat het hier ging om normale handel, waarbij hij geen gestolen zaken behoefte te verwachten; Er is dan ook geen reden om de transactie tussen Koster en Wolterink van de bescherming van art. 3:86 BW lid 3 uit te sluiten. De caravan hoefde derhalve niet duurzaam met de grond te zijn verbonden, omdat het een voor deze handel een normale bedrijfsruimte betrof. De vordering van Uitslag kan dus niet slagen, aangezien Wolterink beschermd werd, dus beschikkingsbevoegd was en de eigendom van de caravan aan Uitslag heeft kunnen overdragen.
De Hoge Raad verwerpt het beroep.
