Is Damhof eigenaar van de meubels uit Duitsland?

Feiten
Damhof had in oktober 1944 een partij meubels van een Berlijns bedrijf gekocht. Deze goederen werden opgeslagen in een Rotterdamse loods. Na de bevrijding van de Tweede Wereldoorlog hebben de staatsorganen deze goederen in de loods in beslag genomen. De waarde in de loods bedroeg 17.466 gulden dat zich verhield tot de waarde in 1940 tot een bedrag van 61.131 gulden. Damhof eiste daarom 61.131 van de staat. De rechtbank verwierp dit.
Hoge Raad
Daar het hier een transactie met de vijand betrof, was ingevolge het besluit rechtsverkeer in oorlogstijd van 7 juni 1940 (Stb. Nr A 6) de koopovereenkomst en daarmee ook de titel ongeldig. De geldigheid van de overdracht was afhankelijk van de geldigheid van de titel: 'De levering kan de verkrijger alleen dan eigenaar maken indien zij plaats heeft krachtens geldige titel', meende de Hoge Raad. Om die reden werd Damhof niet eigenaar van de meubels
