Kraaien en roeken (HR 10-03-1972, NJ 1972, 278)
Casus
Het arrest Kraaien en roeken valt, net als het arrest Lindenbaum-Cohen, te scharen onder de arresten die gaan over de onrechtmatige daad. In dit arrest gaat het om het onrechtmatigheidscriterium ‘inbreuk op een recht’.
Direct naast het perceel grond dat Vermeulen als vuilstortplaats gebruikt, ligt de fruitboomgaard van Lekkerkerker. Er komen veel kraaien en roeken op de vuilstort af die het fruit in de boomgaard vernielen, zodat Lekkerkerker schade lijdt. Vermeulen heeft een Hinderwetvergunning voor de vuilstortplaats.
Rechtsvragen
Moet de hinder die iemand in het genot van de eigendom van zijn onroerende aak kan ondervinden, worden beschouwd als een inbreuk op diens eigendomsrecht?
Moet Vermeulen de schade van Lekkerkerker vergoeden?
Hoge Raad
‘(…) dat, in aanmerking genomen de aard en de plaats van de door partij Vermeulen ondernomen activiteiten en de ernst van de als gevolg daarvan door partij Lekkerkerker ondervonden schade, het Hof zonder schending van enige rechtsregel heeft kunnen oordelen dat die activiteiten aan partij Lekkerkerker een hinder hebben toegebracht, welke deze niet behoefde te dulden en dat partij Vermeulen daardoor een inbreuk heeft gemaakt op het eigendomsrecht van partij Lekkerkerker, welke (…) als een onrechtmatige daad moest worden beschouwd’.
Vermeulen maakte dus een inbreuk op het eigendomsrecht van Lekkerkerker en derhalve diende hij de schade te vergoeden. Het hebben van een Hinderwetvergunning voor een bepaalde activiteit houdt dus niet in dat iemand niet meer aansprakelijk kan worden gesteld voor een onrechtmatige daad die ontstaat door de vergunde activiteit. De vraag of er sprake is van een inbreuk op het eigendomsrecht, dient beantwoord te worden aan de hand van de ernst van de hinder en de omstandigheden waaronder de hinder plaats heeft gehad.
