Casus
Het komt zelden voor dat de Hoge Raad een wetsbepaling in een wet in formele zin toetst aan een verdragsbepaling di een ieder verbindt en dat hij dan zo’n bepaling uit een wet in formele zin buiten toepassing laat (conform art. 94 grondwet). Dit is echter wel gebeurd in het onderhavige arrest.
Het ging om een minderjarig meisje aan de kantonrechter een verzoek om vervangende toestemming voor haar voorgenomen huwelijk had gedaan. De vader-voogd weigerde echter zo’n toestemming (destijds gold art. 36 lid 2 BW nog: een minderjarige kon wel om vervangende toestemming vragen, maar op grond van het tweede lid kon een ouder die het gezag over het kind uitoefende, hier een stokje voor steken).

Mag een wet in formele zin getoetst worden aan verdragen?
Hoge Raad
Ja, een wet in formele zin mag aan verdragen getoetst worden. De Hoge Raad past het tweede lid van art. 1:36 BW niet toe omdat die bepaling onverenigbaar is met de een ieder verbindende verdragsbepaling van art. 12 EVRM. Dit is in overeenstemming met de mogelijkheid die art. 94 Gw daarvoor biedt.
‘Wel kan de nationale wet voorschrijven dat een door een minderjarige te sluiten huwelijk de toestemming behoeft van diens ouders, maar de daarin gelegen beperking van de mogelijkheid voor minderjarigen om te huwen kan – zonder dat aan het in art. 12 EVRM erkende recht tekort zou worden gedaan – niet zover gaan dat aan de ouders of aan een van hen een absoluut, aan rechterlijke controle onttrokken, vetorecht zou worden toegekend’, aldus de Hoge Raad in het arrest.
