Casus
Werknemers van NS voeren onder leiding van de vakbonden collectieve acties tegen de NS. Ze houden stiptheidsacties, langzaamaanacties en werkonderbrekingen van korte duur.
Met deze collectieve acties willen de vakbonden hun verzet aanduiden tegen het voornemen van de minister van Sociale Zaken om het salaris van de werknemers te korten en de zogenaamde prijscompensatie te laten vervallen. De NS dagvaardt de vakbonden en eist stopzetting van de acties.
Rechtsvraag
Hoe dient art. 6 lid 4 Europees Sociaal Handvest (ESH) te worden uitgelegd?
Hoge Raad
Alvorens over te kunnen gaan tot bespreking van het middel stelt de Hoge Raad eerst vast dat art. 6 lid 4 ESH een bepaling is die naar haar inhoud een ieder kan verbinden. Op grond van art. 93 GW heeft het artikel dus rechtstreekse werking in de Nederlandse rechtsorde.
Art. 6 lid 4 ESH geeft werknemers een recht op collectieve acties in het geval van een belangengeschil met hun werkgever. In casu keert de staking zich tot de werknemer, maar is zij gericht tot de overheid. De vakbonden wilden de overheid onder druk zetten om de geplande veranderingen in de arbeidsvoorwaarden niet door te voeren.
Volgens de Hoge Raad mag een staking zich keren tegen de werkgever en zich richten tot de overheid. Dit mag echter alleen als de overheid iets te zeggen heeft over de arbeidsvoorwaarden. Een politieke staking valt niet onder art. 6 lid 4 ESH. Je mag dus niet staken om te proberen iets te veranderen aan het overheidsbeleid.
Nu is vastgesteld dat er een recht op staking bestaat, moet worden gekeken of de staking rechtmatig is. Hiervoor is het van belang dat er eerst overleg heeft plaatsgevonden, de staking het uiterste middel is en deze op tijd is aangekondigd. De rechter moet de noodzakelijkheid terughoudend toetsen omdat staken een grondrecht is. Daarna moet er inhoudelijk getoetst worden. Er moet gekeken worden of de Bonden in redelijkheid tot de actie hadden kunnen komen.
In casu kost de staking de werkgever veel geld, terwijl de werknemers wel werken en dus ook betaald moeten worden. Dit kan echter niet als argument gebruikt worden, nu het doel van een staking juist het onder druk zetten van de werkgever is. Wel zou werkgever een gedeelte van het loon in kunnen houden omdat ze niet optimaal werken.
Voordeel van dit type staking is bovendien dat hij het publiek minder last bezorgt dan een totale werkstaking. De NS hoeft dus ook minder schadeclaims te verwachten.
De collectieve acties vallen dan ook onder art. 6 lid 4 ESH en zijn niet onrechtmatig jegens de NS.
