Casus
Promotiestudenten vorderen dat tussen hen en de universiteit een arbeidsovereenkomst bestaat. De universiteit wijst de vordering af: deze rechtsverhouding is een opleidingsovereenkomst en geen dienstbetrekking. Twistpunt is het bestaan van een gezagsverhouding.
Hof
Vaststaat dat de promotiestudenten hun arbeid gedurende drie opeenvolgende maanden, wekelijks dan wel gedurende ten minste twintig uren per maand hebben verricht. Zij beroepen zicht terecht op het wettelijk vermoeden van artikel 7:610a BW. Dit vermoeden is weerlegbaar. Daarbij is in de eerste plaats de partijbedoeling van belang. Beoogd is een overeenkomst te sluiten waarbij het opleidingsaspect centraal staat. De overeenkomsten zijn c.q. worden uitgevoerd conform deze partijbedoeling. Met betrekking tot het bestaan van een gezagsverhouding is van belang dat de rol van de promotor/begeleider is beperkt tot de bewaking van de voortgang van het promotieplan en tot het geven van aanwijzingen die verband houden met de wetenschappelijke verantwoording. Onder deze omstandigheden verschilt de rol van promotor/begeleider niet wezenlijk van die van de scriptiebegeleider van een reguliere student. Niet gebleken is dat de (formele) instructie- en sanctiemogelijkheden van het faculteitsbestuur bij promotiestudenten verder gaan dan ten opzichte van reguliere studenten. In de overige feitelijke omstandigheden van de promotiestudenten is evenmin grond te vinden voor het oordeel dat tussen de universiteit en de bij haar werkzame promotiestudenten de voor een arbeidsovereenkomst kenmerkende gezagsrelatie bestaat. Het wettelijk vermoeden is daarmee afdoende weerlegd. De gevorderde verklaring voor recht komt niet voor toewijzing in aanmerking.
