Verzekeringspositie prostituees (CRvB 05-01-2006, LJN AV1414)
Casus
In verhuurde kamers van vestigingen van appellant worden bedrijfsmatig diensten verleend door prostituees. UWV heeft van hen verplichte verzekering aangenomen uit hoofde van een privaatrechtelijke dienstbetrekking (artikel 3 ZW, WW en WAO). Is sprake van een privaatrechtelijke dienstbetrekking en verzekeringsplicht of zijn deze prostituees zelfstandig ondernemers?

Er is sprake is van een min of meer geordende geïntegreerde organisatie tussen appellant en betrokken prostituees om enerzijds eerstgenoemde in staat te stellen zijn vestigingen met kamerverhuur optimaal op basis van werkplanning en toegespitst op snel specifiek gebruik te exploiteren en anderzijds betrokkenen de gelegenheid te bieden hun diensten tegen betaling voor de klanten zo adequaat mogelijk met de nodige sturing en onder toezicht te verlenen (algemene omgangs- en huisregels; algemene tariefstellingen voor onderscheidene diensten; regulering door inhoudelijke inroostering met werktijden; gelegaliseerd vergunningsstelsel met toezicht op naleving van de APV en het voorkomen van strafbare feiten; screening op aspecten als nationaliteit, meerderjarigheid en gezondheid). Appellant vervulde als overkoepelend beheerder van meerdere vestigingen onmiskenbaar een betekenende en overheersende rol naar de prostituees toe en de condities waaronder zij werkzaam waren en bezat hij als zodanig als enige de mogelijkheid tot bijsturing, controle en toezicht van een regulier werkgever. Dat de prostituees vrij waren in hun taakvervulling en het bedingen van hun zelf begunstigende bijkomende condities binnenskamers laat onverlet dat zij toch telkens wanneer zij ingeschakeld werden zich onderhevig stelden aan de algemene regulering en wijze van uitvoering onder toezicht welke voor ieder van betrokkenen gold. Door e.e.a. is het bestaan van een gezagsrelatie tussen appellant en huisbeheerder enerzijds en prostituees anderzijds in de zin van artikel 3 van de sociale werknemersverzekeringswetten voldoende gegeven.
Ook aan de overige vereisten voor het aannemen van een privaatrechtelijke dienstbetrekking – dat wil zeggen: de verplichting tot het persoonlijk verrichten van arbeid en een verplichting tot het betalen van loon – is voldaan. De verzekeringsplicht is daarmee van rechtswege gegeven.
