Agfa/Schoolderman (HR 08-04-1994, ECLI:NL:HR:1994:ZC1322)
Casus
Nadat mw. Schoolderman vóór januari 1985 gedurende een aantal jaar wisselend voor AGFA werkzaam was geweest, is vanaf 2 januari 1985 tussen haar en AGFA een arbeidsovereenkomst voor bepaalde tijd gesloten. De hier op volgende aanstellingsbrieven stelden dat zij in dienst trad op uurloonbasis als tijdelijke kracht. Hierna werkte Schoolderman sinds medio 1985 bijna voor de volledige werktijd voor AGFA en zij deed hetzelfde werk als personeel in vaste dienst, maar wel was de honorering middels een uurtarief minder dan die van het vaste personeel.
In dit geding vordert Schoolderman een verklaring voor recht dat tussen haar en AGFA een arbeidsovereenkomst in de zin van art. 7A:1637a BW voor onbepaalde duur geldt, en ook vordert zij betaling van het verschil over de afgelopen 5 jaar als zij als vaste kracht voor onbepaalde tijd was zijn aangemerkt.
Hoge Raad
Het principe van goed werknemerschap (7:611 BW) verplicht Agfa-Gevaert B.V. zich ten opzichte van de werkneemster in kwestie, te weten een werknemer met een nulurencontract (flexibele arbeidsrelatie/oproepkracht), net zo te gedragen als tegen werknemers in vaste dienst. Met andere woorden, dezelfde honorering voor hetzelfde arbeid op grond van het gelijkheidsbeginsel. De redelijkheid en billijkheid (3:12 BW) eisen toepassing van dit beginsel aangezien in casu het vrijblijvende van een nulurencontract verloren is gegaan doordat deze werkneemster al enkele jaren voor praktisch de complete werktijd en nagenoeg zonder onderbreking voor AGFA heeft gewerkt, daarbij hetzelfde werk verrichtend als het vaste personeel maar tegen een minder hoge vergoeding.
Kern
Hoge Raad neemt in deze zaak het algemeen rechtsbeginsel aan dat gelijke gevallen in gelijke omstandigheden recht hebben op gelijke beloning op grond van goed werkgeverschap (art. 7:611 BW). De contractuele relatie tussen partijen wordt niet alleen bepaald door wat zij schriftelijk zijn overeengekomen maar ook door de wijze waarop zij in de praktijk aan de arbeidsovereenkomst uitvoering geven.
