Casus
Werknemer in deze zaak is op 28 januari 1985 in dienst getreden bij de werkgever. De laatste functie die de werknemer vervulde, is die van Adviseur Relatiebeheer & Advies, met een salaris van €3.735,56 bruto per maand exclusief vakantietoeslag en overige emolumenten, waaronder een persoonlijke toeslag. De werkgever is actief op het gebied van afval en milieumanagementbeheer ten behoeve van diverse gemeenten. Op 27 februari 2012 heeft de werknemer zich ziek gemeld. Medio 2012 heeft werknemer een niertransplantatie ondergaan. In de zomer van 2013 was hij weer volledig in het bedrijf geïntegreerd. In overleg is zijn 32-urige werkweek verspreid over vijf werkdagen, zodat hij minder belastbaar hoeft te werken. Werknemer, in casu verweerder, geeft aan dat hij niet altijd als proactief wordt ervaren en niet altijd het juiste gevoel heeft bij de wensen van de gemeente, dat het draagvlak intern niet goed is, waardoor het functioneren als adviseur moeilijk is bij projecten en dat hij als adviseur moeite heeft met collega’s. Door deze uitlatingen verzoekt werkgever om de arbeidsovereenkomst te ontbinden op grond van artikel 7:671b lid 1, onderdeel a, jo. 7:669 lid 3, onderdeel g, BW. Volgens de werkgever is er sprake van een verstoorde arbeidsverhouding en dat van de werkgever niet redelijkerwijs gevergd kan worden dat de arbeidsovereenkomst voortduurt.
Rechtbank
Op grond van artikel 7:669 lid 1 BW kan een arbeidsovereenkomst alleen worden ontbonden, indien daar een redelijke grond voor is en herplaatsing van de werknemer binnen een redelijke termijn niet mogelijk is of niet in de rede ligt. In artikel 7:669 lid 3 BW is nader omschreven wat onder een redelijke grond moet worden verstaan. De werkgever voert aan dat de redelijke grond is gelegen in de tussen partijen verstoorde relatie als bedoeld in artikel 7:669 lid 3, onderdeel g, BW. Nu Twente Milieu nimmer heeft aangegeven niet meer met de werknemer te willen samenwerken, en hem geen verbetertraject is aangeboden, kan men niet spreken van een redelijke grond.
