Zo lang de stille pandhouder aan de betrokken debiteuren niet de in artikel 3:246 lid 1, tweede volzin, BW bedoelde mededeling heeft gedaan, is de curator bevoegd in het belang van de boedel tot inning van de betrokken vorderingen over te gaan, waarna de pandhouder op het door de curator geïnde verhaal kan zoeken overeenkomstig de aan zijn pandrecht verbonden voorrang. Omdat dit verhaal dan plaats heeft in het kader van het faillissement, zal de pandhouder daarbij bij dienen te dragen in de algemene faillissementskosten.
De stille pandhouder kan de bevoegdheid tot inning op zich doen overgaan door de bedoelde mededeling aan de debiteuren te doen. Zo lang die mededeling niet is gedaan, en de curator dus nog bevoegd is tot inning ten behoeve van de boedel van de stil verpande vorderingen, is er voor de curator geen reden de stille pandhouder in het belang van de boedel op de voet van artikel 58 lid 1 Fw een (redelijke) termijn te stellen om tot uitoefening van de in artikel 57 Fw bedoelde rechten over te gaan, waartoe de curator ingevolge dat artikellid wel bevoegd, maar niet verplicht is.
Het voorgaande betekent niet dat het de curator vrijstaat de bevoegdheid van de stille pandhouder tot het doen van de mededeling aan de betrokken debiteuren te frustreren door zijnerzijds aanstonds aan die debiteuren mede te delen dat zij de stil verpande vorderingen op de rekening van de boedel moeten voldoen in plaats van op die van de stille pandhouder.
In het algemeen zal bij een professionele stille pandhouder als een bank voldoende zijn dat de curator een redelijk te achten termijn in acht neemt van veertien dagen alvorens een dergelijke mededeling aan de debiteuren te doen. Een verplichting tot het actief vooraf dienaangaande informeren van zo'n stille pandhouder kan niet worden gebaseerd op overeenkomstige toepassing van artikel 58 Fw en ook naar ongeschreven recht bestaat een dergelijke verplichting niet. Dit neemt niet weg dat het, mede ter voorkoming van onnodige onrust bij debiteuren, wenselijk is dat de stille pandhouder en de curator overleg voeren over het te volgen incassobeleid, waartoe de stille pandhouder zo nodig zelf het initiatief kan nemen.
