Rechtsregel
Wanneer de curator wordt geconfronteerd met een vordering uit hoofde van een ná de faillietverklaring ‘zonder rechtsgrond’ gedane betaling, die slechts het gevolg is van een ‘onmiskenbare vergissing’, handelt hij in overeenstemming met hetgeen in het maatschappelijk verkeer als betamelijk wordt beschouwd, indien hij meewerkt aan het ongedaan maken van die vergissing.
De curator is in zo’n geval dan ook verplicht om, nadat hij het onverschuldigd betaalde heeft ontvangen en heeft geconstateerd dat sprake is van een vergissing, uit de beschikbare middelen van de boedel een bedrag gelijk aan dat waarmee de boedel is verrijkt te voldoen aan degene die onverschuldigd heeft betaald.
De aard van deze verplichting brengt mee dat de curator haar zo spoedig mogelijk behoort na te komen, zonder de afwikkeling van de boedel af te wachten en met voorbijgaan van aanspraken van andere boedelcrediteuren.
Ook brengt de aard van die verplichting mee dat de curator te dier zake geen bijdrage in de algemene faillissementskosten mag verlangen en slechts de redelijke kosten in mindering mag brengen die als gevolg van de vergissing en het nakomen van bedoelde verplichting mochten zijn veroorzaakt.
N.B. Van deze situatie moet worden onderscheiden enerzijds de situatie dat aan de schuldenaar vóór diens faillietverklaring zonder rechtsgrond, al dan niet als gevolg van een vergissing, een geldsom is betaald en de schuldenaar de daaruit voortvloeiende verplichting tot teruggave van een gelijk bedrag niet vóór zijn faillietverklaring is nagekomen en anderzijds de situatie waarin een aan de schuldenaar na diens faillietverklaring gedane betaling – ten gevolge van het met terugwerkende kracht tot een vóór de faillietverklaring gelegen tijdstip vervallen van de rechtsgrond – achteraf onverschuldigd bleek te zijn.
