Casus
Een buspassagier werd, zittend in de bus bedreigd door twee mannen. De twee mannen zaten aan de andere kant van het gangpad naast de buspassagier en zij bedreigden de buspassagier door meerdere keren te zeggen dat ze hem in elkaar zouden slaan nadat hij uit zou zijn gestapt. Toen op een bepaald moment één van de twee mannen opstond en, toen de buspassagier ook was opgestaan, hij met zijn borst tegen de borst van de verdachte aanstootte, sloeg de buspassagier hem.
De buspassagier werd mishandeling ten laste gelegd. Hij deed een beroep op noodweer ondanks het feit dat hijzelf de eerste klap had uitgedeeld.
Het Hof
Het Hof verwierp het beroep op noodweer van de buspassagier. Het Hof veroordeelde de verdachte buspassagier daarom voor mishandeling. In de motivering meende het Hof dat er geen sprake was van een ogenblikkelijke wederrechtelijke aanranding en dat daarom het beroep op noodweer niet kon slagen. Het Hof meende wel dat er van een 'escalerende conflictsituatie, waarin een handgemeen dreigde' sprake was.
Hoge Raad
De Hoge Raad meende dat de motivering van het Hof zo intern tegenstrijdig was. Als het Hof van een 'escalerende conflictsituatie, waarin een handgemeen dreigde' melding maakt, dan is dat volgens de Hoge Raad alleen te interpreteren als een aanranding en is de motivering van het Hof intern tegenstrijdig.
