Reflex-werking van art. 31 WVW. Het betreft hier de vraag of het art. 31-risico niet doorwerkt indien het slachtoffer (alle) schuld aan het ongeval heeft, met als gevolg dat de schade aan de zijde van de automobilist voor zijn rekening blijft.
CASUS
Auto en fietser krijgen een aanrijding, te wijten aan schuld van de fietser wordt schade toegebracht aan de auto. De fietser vergoedt slechts helft van de schade, met een beroep op art. 31, inhoudende dat de overige schade voor rekening van de auto-eigenaar moet blijven.
KANTONRECHTBANK
Verwerpt, namelijk art. 31 is niet van toepassing, er is sprake van een onrechtmatige daad, dus schade valt onder de werking van art. 1401.
HOGE RAAD
Art. 31 is er ter bescherming van niet gemotoriseerde verkeersdeelnemers. Dit artikel is van overeenkomstige toepassing bij het hanteren van de regels van het gemene recht. Met name indien aan de zijnde van de auto-eigenaar geen sprake is van overmacht in de zin van art. 31; van overmacht is sprake indien de fouten van de fietser voor de eigenaar zo onwaarschijnlijk waren dat hij bij zijn verkeersgedrag met deze mogelijkheid geen rekening hoefde te houden. (Jan de Waard) Geen overmacht?, dan blijft een deel van de schade voor zijn rekening, afhangende van de mate waarin de fout van de fietser enerzijds en van de in het licht van art. 31 anderzijds aan het motorrijtuig toe te rekenen omstandigheden tot de schade hebben bijgedragen.
Opmerking: dit arrest was voor de Hoge Raad gekomen door cassatie in het belang van de wet.
Opmerking: van Dunne spreekt hier van een verdere afkalving van het schuldbeginsel. Is er nog wel ruimte voor het schuldbegrip van art. 1401 bij de verkeersaansprakelijkheid, vraagt hij zich af. Hij denkt dan van niet, en stelt voor ook dit hoofdstuk van de schuldleer af te sluiten.
