Welke maatstaf dient te worden gehanteerd bij de beoordeling van de vraag of een faillissementscurator persoonlijk aansprakelijk (anders dan aansprakelijkheid q.q.) is jegens derden die nadeel hebben ondervonden van de wijze waarop de curator bij het beheren en vereffenen van de failliete boedel te werk is gegaan?
Onjuist is de stelling dat de aan een faillissementscurator te stellen zorgvuldigheidsnorm in beginsel gelijk is aan die welke geldt voor advocaten en vergelijkbare beroepsbeoefenaren. Zij miskent vooreerst dat een curator, ook al beoefent hij het beroep van advocaat of een daarmee vergelijkbaar beroep, bij het vervullen van zijn taak als curator niet optreedt als beoefenaar van dat beroep. Voorts miskent die stelling dat de curator, anders dan de beoefenaar van een beroep als dat van advocaat, niet in een contractuele betrekking staat tot degenen wier belangen aan hem in zijn hoedanigheid zijn toevertrouwd, alsmede dat hij bij de uitoefening van zijn taak uiteenlopende, soms tegenstrijdige belangen moet behartigen en bij het nemen van zijn beslissingen die vaak geen uitstel kunnen lijden óók rekening behoort te houden met belangen van maatschappelijke aard.
De bijzondere kenmerken van de taak van de curator brengen mee dat zijn eventuele persoonlijke aansprakelijkheid dient te worden getoetst aan een zorgvuldigheidsnorm die daarop is afgestemd. Deze norm komt hierop neer dat een curator behoort te handelen zoals in redelijkheid mag worden verlangd van een over voldoende inzicht en ervaring beschikkende curator die zijn taak met nauwgezetheid en inzet verricht.
