Handelen krachtens een overheidsvergunning vrijwaart niet tegen aansprakelijkheid uit onrechtmatige daad.
Casus
Doordat Vermeulen een plas met stadsvuilnis dumpte, waarvoor hij een vergunning had gekregen, werden zeer veel vogels aangetrokken. Hierdoor werd lonende exploitatie van de nabijgelegen boomgaard van Lekkerkerker onmogelijk. Deze vorderde een schadevergoeding o.g.v. onrechtmatige daad.
Hoge Raad
De vraag of hinder een onrechtmatige daad is hangt af van de ernst van de hinder en de omstandigheden waaronder die plaatsvindt. Dit in aanmerking genomen kan worden vastgesteld dat de activiteiten van Vermeulen een onaanvaardbare inbreuk vormden op het eigendomsrecht van Lekkerkerker Ook al was Vermeulen in het bezit van een Hinderwetvergunning, kon hem een verwijt worden gemaakt.
De regeling van de Hinderwet brengt niet mee dat men schade en hinder die men in het algemeen niet hoeft te dulden, wel zou moeten dulden van iemand die een Hinderwetvergunning heeft
