Eelman/Hin (HR 11-12-1959, NJ 1960, 230)
Casus
In dit arrest is voor het eerst de vertrouwensleer geformuleerd: wie in gerechtvaardigd vertrouwen is afgegaan op de verklaring van een ander, wordt onder een aantal voorwaarden wettelijk beschermd, als blijkt dat bij die ander wil en verklaring niet met elkaar overeenstemden.
In casu ging het om Eelman, die zijn boerderij verkocht aan Hin. Een aantal maanden later laat Eelman aan Hin weten niet tot levering bereid te zijn, omdat hij op het moment van verkoop leed aan een zeer ernstige geestesziekte (schizofrenie), zodat hij op dat moment niet besefte wat hij deed. Hij vordert bij de rechtbank vernietiging van de koopovereenkomst. Volgens een door de rechtbank ingeschakelde psychiater was Eelman ten tijde van de verkoop daadwerkelijk niet in staat geweest zijn wil te bepalen.
Rechtsvraag
Kon de koopovereenkomst worden vernietigd op grond van art. 3:34 BW of blijft deze in stand wegens art. 3:35 BW?
Rechtbank
De Rechtbank bepaalde dat koper zal moeten aantonen dat hij, ten tijde van het aangaan van de koopovereenkomst, niet beschikte over zijn verstandelijke vermogens én dat verkoper dat toen had begrepen of redelijkerwijze had moeten begrijpen.
Hof
In hoger beroep schaart het Hof zich achter de stelling van de rechtbank.
Hoge Raad
Eelman heeft geen succes. ‘(…) in de eerste plaats gelet wordt op de eisen van het rechtsverkeer, welke althans voor overeenkomsten onder bezwarenden titel verlangen, dat ten aanzien van degene die afgaat op een bij hem opgewekte schijn, het daardoor gerechtvaardigde vertrouwen wordt beschermd tegenover hem, die deze opriep’, aldus de Hoge Raad.
Het arrest leert aldus dat bij rechtshandelingen van feitelijk onbekwamen er gekeken dient te worden of de wederpartij gerechtvaardigd heeft vertrouwd op de bekwaamheid van de feitelijk onbekwame. Indien dit het geval is, is de overeenkomst geldig.
