Booy/Wisman - Arrest

Casus
Eiser tot cassatie, Booy, is door verweerder in cassatie, Wisman, gedagvaard voor de rechter. Wisman kocht in 1962 een mobiele kraan bij Booy. Wisman heeft bij de koop aangegeven dat de kraan wel in aanmerking moet komen voor een kentekenplaat, omdat de kraan zich via de openbare weg van de ene locatie naar de andere locatie zal moeten voortbewegen. De mobiele kraan is volgens Wisman bedoeld om schepen te lossen op verschillende locaties. Bij de koop heeft Booy aangegeven dat de kraan zeker zal worden voorzien van een kenteken, omdat deze aan de vereisten voor het kenteken voldoet. Mede dankzij deze mededeling besluit Wisman om de kraan te kopen, waarna er een koopovereenkomst wordt gesloten. Als Wisman vervolgens met de mobiele kraan naar het keurcentrum gaat, komt hij erachter dat de kraan, die hij zojuist bij Booy had gekocht, niet in aanmerking komt voor een kenteken en zich dus niet via de openbare weg kan voortbewegen. Wisman beroept zich bij de rechtbank op dwaling, omdat hij de kraan niet zou hebben gekocht, als hij had geweten dat deze niet in aanmerking zou komen voor een kentekenbewijs. Daarbij heeft Wisman de koopovereenkomst ontbonden.
Hoge Raad
De Hoge Raad zal moeten beoordelen of er in deze situatie beroep kan worden gedaan op dwaling op grond van art. 6:228 lid 1 BW. De Hoge Raad oordeelt dat er geldig beroep kan worden gedaan op dwaling, als er een onjuiste voorstelling wordt gedaan van zaken. In casu had Wisman namelijk nooit de kraan gekocht, als hij van tevoren had geweten dat deze niet in aanmerking zou komen voor een kentekenbewijs. Wisman doet dus op grond van art. 6:228 lid 1 BW succesvol beroep op dwaling, ondanks het feit dat de dwaling pas werd geconstateerd na de koop. De Hoge Raad constateert dus dat een koper altijd beroep kan doen op dwaling, als hij tijdens de koop een onjuiste voorstelling van zaken had, waardoor hij de koopovereenkomst bij de juiste voorstelling van zaken nooit was aangegaan.
