Van Venrooij/Ameva - Arrest
Van Venrooij/Ameva (HR 05-02-1999, NJ 1999, 652)
Feiten
Van Venrooij is sinds oktober 1990 in dienst bij Ameva als chef montage. Drie jaar later, in november 1993, tekent Van Venrooij een verklaring waarbij hij akkoord gaat met de beëindiging van de arbeidsovereenkomst. Hij was bij de directeur geroepen zonder enige aankondiging en/of waarschuwing over het te bespreken thema en tekende toen de verklaring. Na een paar dagen komt Van Venrooij hierop terug. Ameva richt zich dan tot de rechter en vordert ontbinding van de arbeidsovereenkomst. Van Venrooij stelt dat hij niet aan zijn verklaring kan worden gehouden omdat er sprake is geweest van misbruik van omstandigheden door de werkgever en hij niet in alle vrijheid zijn wil heeft kunnen bepalen.
Hoge Raad
De Hoge Raad geeft aan dat Van Venrooij op kantoor werd geroepen, onvoorbereid, zonder onderhandelaar, en zonder kennis van het ontslagrecht. Ameva had een aanzienlijke overwichtspositie en er werd druk uitgeoefend op de werknemer om te tekenen. Voorts was hem gezegd dat allerlei procedures zouden volgen als hij niet zou tekenen en dat hij met het tekenen recht op werkloosheidsuitkering zou krijgen. De Hoge Raad stelt dat Van Venrooij bij een behoorlijke voorbereiding niet zou hebben getekend.
De Hoge Raad bepaalt dat in zo’n situatie van misbruik van omstandigheden sprake zal zijn als de werkgever 1) wist of had behoren te weten dat de werknemer door bijzondere omstandigheden (zoals door afhankelijkheid of onervarenheid) bewogen werd tot het geven van die instemming en 2) hij desondanks de instemming van de werkgever bevorderde terwijl hetgeen hij wist of had moeten begrijpen hem had behoren te weerhouden. De Hoge Raad kwam mede gelet op de onervarenheid van de werknemer en de overwichtspositie van de werkgever tot de conclusie dat sprake was van misbruik van omstandigheden.
De rechtbank had gesteld dat voor een beroep op misbruik van omstandigheden ook vereist is dat men nadeel heeft geleden. De Hoge Raad veegt dat van tafel en stelt dat 3:44 lid 4 BW die eis niet stelt.
Kern
De Hoge Raad heeft overwogen dat onervarenheid van de werknemer en de overwichtspositie van de werkgever tot de conclusie kan leiden dat er sprake is geweest van misbruik van omstandigheden. Ook wanneer omstandigheden zich in de praktijk vaker voordoen staat dit niet in de weg aan het oordeel dat in een specifieke situatie sprake is van misbruik van omstandigheden. Ook geeft de Hoge Raad aan dat het nadeel dat door misbruik van een omstandigheid wordt veroorzaakt niet van vermogensrechtelijke aard hoeft te zijn.
