Feiten
Werknemer Westhoff, een vrachtwagenchauffeur, meende dat was afgesproken dat hij bij aankomst na een lange reis per auto opgehaald zou worden. Toen dit niet gebeurde, zei hij: "Ik pak mijn zooitje, je bekijkt het maar en ik kom niet terug". Hij nam zijn bezittingen die hij normaal niet meenam uit zijn vrachtwagen en vertrok. Vervolgens is hij de komende twee werkdagen niet komen opdagen. Westhoff vordert doorbetaling van zijn salaris, omdat hij niet werkelijk gewild had ontslag te nemen.
Rechtbank
De kantonrechter wijst zijn vordering af en de rechtbank bekrachtigt dit vonnis. In cassatie wordt aangevoerd dat de werkgever Spronsen had behoren te onderzoeken of Westhoff de bedoeling had ontslag te nemen en vervolgens dat, wanneer hij dit mocht aannemen, zij Westhoff alleen daaraan mocht houden wanneer zij in gerechtvaardigd vertrouwen op de daardoor bij haar gewekte schijn van ontslagneming iets had gedaan of nagelaten waardoor zij bij ongedaanmaking van het ontslag in een ongunstiger toestand zou zijn gekomen dan waarin zij zonder die ontslagneming zou hebben verkeerd.
Hoge Raad
De Hoge Raad laat het oordeel van de rechtbank in stand, aangezien Westhoff de 'afkoelingsperiode' (de dagen na het ontslag) niet had gebruikt om zijn ontslag te herroepen en hij was die dagen ook niet op zijn werk verschenen. Westhoff kan zich niet beroepen op art. 3:34 BW: gelet op zijn functie begreep hij de taal en was er geen sprake van dat hij zich niet bewust was wat hij had gedaan. Bij zo'n nadelige positie waarin Westhoff is terechtgekomen rust er normaal gesproken een zwaardere onderzoeksplicht bij de werkgever. Maar door de passieve houding heeft de werkgever in casu aan zijn plicht voldaan, de werknemer had een paar dagen om op zijn ontslag terug te komen. De conclusie luidt dat er een geldig ontslag heeft plaatsgevonden.
