Feiten
Ruiz is exploitant van een loterij, genaamd Catoochi. Op een door Gomez gekocht Lot is een prijs gevallen. Dergelijke loterijen zijn echter bij wet op Aruba verboden. Gomez heeft terzake uitbetaling van de prijs te garanderen, beslag laten leggen op zaken van Ruiz. Ruiz is echter van mening dat, nu hier sprake is van een verboden handeling, hij tot niets gehouden is en vordert derhalve opheffing van het conservatoire beslag.
Procesverloop
Ruiz dagvaart Gomez tot opheffing van het gelegde conservatoire beslag voor het Gerecht in Eerste Aanleg, welke na beraadslaging weigert over te gaan tot opheffing. Hierop gaat Ruiz in hoger beroep bij het Gemeenschappelijk Hof, die het bestreden vonnis bekrachtigd. Ruiz tekent daarop cassatie aan bij de HR.
Rechtsregel
Het Gemeenschappelijk Hof heeft geconcludeerd, dat maatschappelijke ontwikkelingen in brede lagen van de Arubaanse samenleving hebben bewerkstelligd, dat dergelijke als door Ruiz gehouden loterijen niet als onwenselijk, strafbaar of illegaal worden beschouwd en derhalve ook door de overheid worden gedoogd. Het enkele feit derhalve, dat een dergelijke loterij bij wet is verboden, kan dan ook niet leiden tot nietigheid van de overeenkomst van verkoop van een lootje. Geconcludeerd dient te worden, dat de overeenkomst rechtsgeldig is.
