Citronas BV/Gemeente-Energiebedrijf Rotterdam - Arrest
Citronas BV/Gemeente-Energiebedrijf Rotterdam (HR 28-10-1994, NJ 1995/629)
In deze casus ging het om het Rotterdams Energiebedrijf (GEB) dat elektriciteit leverde aan Citronas, een importeur van fruit. Citronas slaat het fruit in de koeling op. Door een rekenfout bij het berekenen van de verbruikte elektriciteit brengt GEB slechts een zesde van het werkelijke verbruik bij Citronas in rekening. De eis van het GEB is dat de elektriciteit die de afgelopen twee jaar niet in rekening is gebracht maar wel is verbruikt alsnog wordt betaald. Citronas verweert zich met de stelling dat zij er gerechtvaardigd op mocht vertrouwen dat alle elektriciteit was betaald. Het Hof oordeelde dat GEB gelijk had en dat Citronas er niet zomaar op mocht vertrouwen dat de afrekening van het GEB definitief was. De Hoge Raad stelt Citronas echter in het gelijk. GEB mocht in beginsel ook betaling verlangen als niet alle elektriciteit in rekening was gebracht. Echter, zo oordeelde de Hoge Raad, op grond van de redelijkheid en billijkheid mag dit niet meer verlangd worden. Citronas mocht er namelijk op vertrouwen dat het in casu om een definitieve afrekening ging. Alle omstandigheden van het geval moeten in aanmerking worden genomen om het definitieve karakter van de rekeningen te kunnen beoordelen. Citronas stelt dat de kosten van elektriciteit doorberekend worden aan haar klanten en dat de eindafrekening voor haar dus een belangrijk gegeven is. Voor de beantwoording van de vraag of de afrekeningen als eindafrekeningen beschouwd kunnen worden verwijst de Hoge Raad de zaak terug naar het Hof.
