Commercieel draagmoederschap: internationale en nationale regelgeving gewenst - Frohn - Artikel
De Gammy zaak heeft de discussie rond commercieel draagmoederschap aangewakkert en een reden gegeven waarom zowel internationale als nationale regelgeving rondom dit onderwerp wenselijk is. Gammy, wiens moeder werd betaald door een Australisch echtpaar om draagmoeder te zijn en beviel daarop van een tweeling: een gezond meisje en Gammy, een jongen met het sydroom van down. Het Australische echtpaar nam alleen het gezonde meisje mee als hun dochter; Gammy werd bij zijn moeder achtergelaten.
Op nationaal niveau is er behoefte aan regelingen omtrent de eisen die aan draagmoeders en wensouders gesteld worden. Hoe het zit met de juridische afstamming van het kind en de registratie van de geboorteakte? Op internationaal niveau wordt op dit moment gewerkt aan een onderzoek naar de haalbaarheid en wenselijkheid van een internationaal verdrag omtrent draagmoederschap. Dit lijkt voor de hand te liggen met het oog op de groeiende hoeveelheid wensouders die jaarlijks naar het buitenland gaan om een draagmoeder te 'regelen'. Deze ouders hebben een heleboel (juridische) vragen omtrent het proces en hun kind; wat is de juridische afstamming van hun kind? Zijn de wensouders in het geboorteland van het kind zijn/haar juridische ouders? En hoe zit dit in het land waar de wensouders met hun kind gaan wonen? Bezit de draagmoeder dezelfde juridische status in het geboorteland van het kind als in het land van de wensouders? Deze en nog veel meer vragen omtrent het commerciële draagmoederschap vereisen een internationaal verdrag om duidelijkheid te scheppen.
