De politie valt een pand binnen waar IRA-leden een undercoveragent gevangen houden. John Murray wordt gearresteerd op basis van een "order against terrorism". Murray blijft zwijgen. De opsporingsambtenaren attenderen hem er op, dat in deze wet staat, dat de rechter de nodige conclusies mag trekken als hij nalaat bepaalde feiten te noemen terwijl hij wordt ondervraagd. Murray wordt door de rechter veroordeeld. Een politieman had hem de trap af zien lopen van het pand en de undercover agent had hem gezien. Murray gaat een procedure voor het Hof en de Commissie instellen op grond van schending van art 6 EVRM.
Zwijgen kan op zichzelf niet voor schuld zorgen. In deze casus was al zoveel bewijsmateriaal tegen de verdachte, dat een verklaring van de verdachte alleen maar ten voordele van Murray zou kunnen zijn. Onder deze omstandigheden was het niet meer dan normaal dat de rechter het zwijgen mocht interpreteren. Verder was er geen ontoelaatbare dwang uitgeoefend door de opsporingsambtenaren en werd hem duidelijk verteld hoe de wet in elkaar zat en wat de gevolgen voor niet verklaren konden zijn. Er was geen schending met artikel 6 EVRM.
In die zaak druiste het handelen van de Justitiele autoriteiten rechtstreeks in tegen het nemo tenetur-beginsel omdat die autoriteiten door middel van een tegen Funke ingestelde strafvervolging probeerden hem te dwingen om bewijs tegen zichzelf te leveren. Er was te veel dwang. Dat is in strijd met het verdrag.
