Lexanruit - Arrest

Casus
Verdachte stond op de uitkijk bij het plegen van een inbraak in een juwelierswinkel. Het is bij een poging gebleven. Achter de met een schop ingeslagen etalageruit bevond zich een lexanruit, die stand hield. Bovendien trad de alarminstallatie in werking, waarop de inbrekers de benen namen. Het hof oordeelt dat sprake is van medeplichtigheid aan een strafbare poging. Het verwerpt daartoe het verweer dat de poging absoluut ondeugdelijk was (er was nog een andere, niet van lexanruit voorziene toegang tot de winkel, zodat het niet absoluut onmogelijk was met de schop een toegang tot de winkel te forceren) en het beroep op vrijwillige terugtred (verdachte is ten gevolge van de buiten zijn wil gelegen omstandigheid dat de alarmschel ging werken op de vlucht geslagen).
Hoge Raad
In het algemeen zal voor een dader die het voornemen heeft opgevat om met het oogmerk van wederrechtelijke toe-eigening uit de etalage van een juwelierswinkel niet aan hem toebehorende sieraden of goederen van zijn gading weg te nemen en die sieraden of goederen onder zijn bereik te brengen door de etalageruit te vernielen althans daarin een gat te breken, het slaan van een gat in die etalageruit met een schop een begin van uitvoering van dat voornemen opleveren. Dit is niet anders, wanneer zich achter die etalageruit nog een lexanruit blijkt te bevinden welke een verwezenlijking van genoemd voornemen door het slaan van een gat in die etalageruit onmogelijk maakt. Het hof heeft mitsdien terecht geoordeeld dat i.c. sprake was van een – relatief ondeugdelijke – strafbare poging, wat er zij van de gronden die het daarvoor heeft aangevoerd.
Het hof heeft beroep op vrijwillige terugtred verworpen op een grond welke die beslissing kan dragen.
De Hoge Raad verwerpt het beroep.
