Het lijkt erop dat steeds meer 60-plussers in aanraking komen met justitie. In dit artikel wordt gekeken naar een aantal mogelijk verklaringen voor dit verschijnsel.
Introductie
Ouderen komen steeds vaker voor de rechter. Deze tendens wordt de komende jaren doorgezet, zo verwacht het openbaar ministerie (OM). Slechts 1,6% van het aantal gedetineerden is 60 jaar of ouder. In verhouding is dit weinig en dit wordt waarschijnlijk veroorzaakt doordat op oudere leeftijd minder delicten plaatsvinden en ouderen minder vaak een gevangenisstraf krijgen (dit laatste wordt overigens door het OM tegengesproken). Ook personen van 55 jaar en ouder hebben in verhouding steeds vaker te maken met justitie. De vergrijzing biedt hier geen volledige verklaring voor.
Mogelijke verklaringen
Psychiatrische problemen (bijvoorbeeld dementie, bipolaire stoornis en schizofrenie) komen relatief veel voor bij delinquente ouderen. De helft van deze gewelddadige ouderen pleegde voor het eerst een misdrijf; bij jongeren is dat maar een kwart. De prevalentie van dementie is bijvoorbeeld tussen 1990 en 2004 met 50% toegenomen en er moet gekeken worden of dit een verklaring kan bieden voor de stijging van het aantal delinquente ouderen. Verslaving kan ook een rol spelen bij delinquent gedrag van ouderen. Zo is verslaving bij ouderen toegenomen. De kosten daarvan en het daaruit voortvloeiende gebrek aan geld kunnen aanleiding geven tot delinquent gedrag.
Ook sociaaleconomische redenen kunnen verklaren waarom ouderen meer delinquent gedrag vertonen. Cijfers laten echter zien dat ouderen het over het algemeen de laatste jaren financieel beter hebben dan voorheen. Dit geldt echter niet voor iedereen; 200.000 ouderen leven onder de armoedegrens. Als ouderen het idee hebben dat anderen uit hun omgeving er materieel gezien op vooruitgaan vergeleken met henzelf, kan dit een rol spelen bij delinquentie. Dit wordt ook wel relatieve deprivatie genoemd. Hierdoor zouden ouderen vaker bijvoorbeeld vaker in drugs handelen. Verder kan het zijn dat de morele principes nu niet alleen meer onder jongere mensen vervagen, maar ook de ouderen bereikt hebben.
Mogelijk spelen ook juridische aspecten een rol bij de toename van de criminaliteit onder 60-plussers.
Verder kunnen problemen van psychosociale aard kunnen een rol spelen. Ouderen hebben steeds meer te maken met eenzaamheid en delinquent gedrag kan een manier zijn om aandacht te trekken. Er is in Nederland sprake van een ‘dubbele’ vergrijzing: Niet alleen het aantal mensen van 65 jaar en ouder neemt toe, maar ook het aantal 80-plussers. Vooral vrouwen zijn vaak alleenstaand vanaf 70 jaar.
Sociaal isolement en verveling door het verlies van of ruzie met naaste familieleden kunnen een motief zijn voor delinquent gedrag bij ouderen. Het zou hierbij gaan om kleine diefstallen, waardoor de dagelijkse sleur doorbroken wordt en nieuwe prikkels gecreëerd worden.
Gevangenissen en strafrecht bij ouderen
Delicten bij ouderen zijn enorm divers en daardoor is het gecompliceerd om bijvoorbeeld ouderenstrafrecht in te voeren. In Japan zijn speciale gevangenissen voor ouderen gebouwd en men stelt dat eenzaamheid, verminderde traditionele sociale relaties en familierelaties en armoede de hoofdoorzaken zijn van crimineel gedrag bij ouderen. In Nederland is echter nog geen aanleiding geweest om speciale gevangenissen voor ouderen te bouwen.
Conclusie
Een verklaringsmodel met meerdere factoren lijkt crimineel gedrag bij ouderen het beste te voorspellen. Zo kunnen psychiatrische en sociaaleconomische problemen, juridische aspecten en psychosociale problemen allemaal een deel van de problematiek verklaren, maar geen één factor kan het geheel verklaren. Daarom moet er meer onderzoek gedaan worden naar deze factoren en hun verhouding tot epidemiologische factoren. Vervolgens kan bepaald worden in hoeverre er dingen veranderd moeten worden in bijvoorbeeld het strafrecht of gevangenissen.
