Gäfgen t. Duitsland (EHRM 01-06-2010, NJ 2010 628)
Feiten
In deze zaak gaat het om de ontvoering van en moord op een jongen van 11 jaar door de Duitser Magnus Gäfgen. De politie ging bij de aanhouding uit van het feit dat de jongen nog leefde en tijdens het politieverhoor werd Gäfgen bedreigd met een gewelddadige ondervraging en dat zij hem pijn zouden doen als hij niet zou bekennen waar de jongen zich zou bevinden. Gäfgen was bang en bezweek. Onder druk vertelde hij dat de jongen al gedood was. Verder hielp hij de politie met het bewijs en leidde hen tot het lichaam van de door hem ontvoerde jongen. Hij werd uiteindelijk veroordeeld, mede op grond van een tweede bekentenis die hij voor de rechter had afgelegd.
De vraag die dan centraal staat, betreft de gebruikte verhoortechniek en hoe absoluut het verbod op foltering is. M.a.w. hoe weegt het recht op leven op tegen het absolute verbod van artikel 3 EVRM. Verder dient het EHRM zich te buigen over de vraag of bewijs, verkregen door middel van een schending van het absolute verbod op een onmenselijke en vernederende behandeling,aangewend kan worden in een eerlijk strafproces.
EHRM
Bedreigen met geweld en gebruik van geweld in verhoorsituaties is in beginsel niet toegestaan. Het Hof aanvaardt dat de bedreiging met geweld louter werd aangewend om het leven van het slachtoffer te redden, en geeft wel aan dat dit onmenselijke behandeling is geweest (in strijd met art. 3 EVRM).
Het Hof neemt een schending van het folterverbod (artikel 3 EVRM) aan vanwege de bedreiging met foltering. Echter het bewijs dat was afgedwongen werd niet tegen Gäfgen gebruikt. Ter terechtzitting legde Gäfgen namelijk vrijwillig een volledige, nieuwe bekentenis af. Ongeoorloofde dwang leidt dus niet direct tot een schending van het nemo-teneturbeginsel. Volgens het Hof werd zijn recht op een eerlijk proces niet geschonden.
Het EHRM vindt het gebruik van het door ongeoorloofde dwang verkregen bewijs doorslaggevend voor een schending van het nemo-teneturbeginsel. De schending van het folterverbod levert niet direct een schending van het nemo-teneturbeginsel op. Want i.c. heeft Gäfgen zijn proceshouding kunnen bepalen en heeft er voor gekozen bekennend te verklaren.
Kern
Het Hof stelt een schending van artikel 3 EVRM vast, maar oordeelt dat artikel 6 niet is geschonden omdat de veroordeling gebaseerd is op de tweede bekentenis.
