Casus
Een man wordt er van verdacht om het slachtoffer opzettelijk van het leven te beroven. Verdachte raakte in gevecht met het slachtoffer. Uit verklaringen wordt duidelijk dat het slachtoffer de verdachte als eerste heeft geslagen. Verdachte slaat het slachtoffer terug en als het slachtoffer dan op de grond ligt springt verdachte in en op het slachtoffer en schopt tegen zijn hoofd. Het feit wordt gekwalificeerd als een poging tot doodslag. De verdachte beroept zich op noodweer, respectievelijk noodweerexces. Volgens de Staat is dit niet het geval. Dit blijkt onder andere uit het feit dat hij een posttraumatische stressstoornis heeft.
Rechtsvraag
Is er sprake van noodweer ondanks het bestaan van een posttraumatische stress stoornis?
Hoge Raad
De gedraging moet het "onmiddellijk gevolg" zijn van een hevige gemoedsbeweging die is veroorzaakt door een wederrechtelijke aanranding. Dat houdt in dat de veroorzaakte gemoedsbeweging van doorslaggevend belang moet zijn geweest voor de verweten gedraging. Andere factoren kunnen hebben bijgedragen aan de hevige gemoedsbeweging, maar aan het gevolgvereiste is niet voldaan als de hevige gemoedsbeweging in essentie is terug te voeren op een eerder bestaande emotie, bijvoorbeeld al bestaande kwaadheid jegens het slachtoffer. Bij de beantwoording van de vraag ff er in dit geval sprake is van het vereiste ‘onmiddellijk gevolg’ is het van belang om de mate waarin de grenzen van de noodzakelijke verdediging zijn overschreden en ook de aard en de intensiteit van de hevige gemoedsbeweging. Ook het tijdsverloop kan relevant zijn. In dit geval heeft verdachte een zo hevige gemoedsbeweging gehad dat hij is ingesprongen op en heeft geschopt tegen het hoofd van het slachtoffer. De gemoedsbeweging moet dus van doorslaggevend belang zijn geweest voor de verweten gedraging. Het feit dat er bij verdachte een posttraumatische stressstoornis aanwezig was doet daar niet aan af. Het heeft misschien bijgedragen aan de hevige gemoedsbeweging maar de hevige gemoedsbeweging is niet in essentie terug te voeren op die omstandigheid.
