De feiten
Taxichauffeur 1 heeft geen geld mogen ontvangen van een klant. Zij is daarbij ook door deze klant bedreigd. Taxichauffeur 2 en 3 zijn vervolgens verhaal gaan halen bij deze man. Taxichauffeur had dit hen afgeraden omdat de klant waarschijnlijk zeer agressief zou zijn. Taxichauffeur 2 en 3 besloten toch te gaan. Hierbij hebben ze zich willens en wetens in een situatie begeven waarin een agressieve reactie van de klant kon worden verwacht.
Daar aangekomen bleek de klant inderdaad zeer agressief, waardoor er een worstelpartij ontstond. De klant had daarbij zijn koevoet gepakt. Taxichauffeur 2 wist deze koevoet te bemachtigen en heeft de klant daarmee vervolgens geslagen. Vraag is nu of er sprake was van noodzakelijke verdediging of dat een beroep hierop niet zou slagen, omdat er sprake zou zijn van culpa in causa.
De beslissing
De HR heeft vervolgens gesteld dat gedragingen voorafgaande aan een wederrechtelijke aanranding onder omstandigheden een beroep op noodweer of noodweerexces in de weg staan. Bijvoorbeeld omdat de wederrechtelijke aanranding is uitgelokt.
Echter, zo stelt het Hof, de enkele waarschuwing dat iemand agressief kan zijn, is onvoldoende om aan te nemen dat er sprake is van culpa in causa. In casu kan taxichauffeur 2 zich dus geldig beroepen op noodweerexces, dan wel noodweer.
