Changoe/Staat - HR - 1992 - Arrest
Casus
Belastingambtenaar Changoe heeft beroep ingesteld bij het Ambtenarengerecht tegen het besluit hem te ontslaan. Het beroep is gegrond verklaard. De Staatssecretaris heeft daarop het ontslagbesluit ingetrokken. Een en ander heeft tot gevolg gehad dat het door Changoe gederfde salaris betaalbaar is gesteld. Changoe vordert van de Staat vergoeding van de schade als gevolg van de inmiddels ingetrokken besluiten van de Staat, welke besluiten ten aanzien van Changoe in zijn hoedanigheid van ambtenaar zijn genomen. De rechtbank heeft beslist dat zij onbevoegd is van deze vordering kennis te nemen. De HR heeft geoordeeld dat art. 3 Ambtenarenwet meebrengt dat geschillen over schuldvorderingen die uit de rechtsbetrekking tussen overheid en ambtenaar voortvloeien, voor zover daarbij sprake is van een klacht over een besluit, handeling of weigering van de overheid, met terzijdestelling van de algemene regel van art. 2 Wet RO aan de kennisneming van de burgerlijke rechter zijn onttrokken.
Rechtsregel
In dit arrest wordt het stelsel van aanvullende rechtsbescherming van de burgerlijke rechter ook van toepassing geacht op de verhouding tussen de burgerlijke rechter en de ambtenarenrechter. Wanneer een administratieve rechter bevoegd is van het geschil kennis te nemen, doet dat in het algemeen niet af aan de bevoegdheid van de burgerlijke rechter op grond van artikel 2 Wet RO, met name niet aan zijn bevoegdheid m.b.t. vorderingen uit onrechtmatige daad. Wel dient de eiser door de burgerlijke rechter niet ontvankelijk te worden verklaard, wanneer, kort gezegd, de administratieve rechter voldoende bescherming biedt. Dus in dit geval: wel bevoegd, maar niet ontvankelijk.
